If you believe the Village did not provide reasonable access or discriminated based on disability, you may file a written complaint with the ADA Coordinator. The Village will review and respond in a timely manner.
ADA Grievance Procedure
This Grievance Procedure is established to meet the requirements of the Americans with Disabilities Act of 1990. It may be used by anyone who wishes to file a complaint alleging discrimination on the basis of disability in the provision of services, activities, programs, or benefits by the Village of Germantown.
Step 1 – Filing a Complaint:
A grievance should be submitted in writing to the ADA Coordinator within 60 days of the alleged violation.
The complaint should include:
The complainant’s name, address, and phone number;
A description of the alleged violation;
The date and location of the incident; and
The names of any individuals involved, if known.
Alternative means of filing (such as email, phone, or accessible formats) will be made available upon request to accommodate individuals with disabilities.
Step 2 – Review and Response:
Within 15 business days, the ADA Coordinator (or designee) will contact the complainant to acknowledge receipt and schedule a meeting to discuss the grievance and possible resolutions.
As part of this review, the ADA Coordinator may engage in an interactive process with the complainant to gather additional information and explore reasonable modifications, accommodations, or other potential remedies.
The interactive process may take time depending on the complexity of the issue and coordination needed with relevant departments, contractors, or accessibility specialists. Every effort will be made to complete this process as promptly as possible.
At the conclusion of the interactive process — once all options have been considered or exhausted — the ADA Coordinator will issue a written decision describing the findings and any actions to be taken. When appropriate, this response will be provided in a format accessible to the complainant.
At any point during the interactive process, the complainant may choose to end participation and request to move directly to an appeal (see Step 3). In such cases, the complainant should explain why they no longer wish to continue in the interactive process.
Step 3 – Appeal:
If the complainant is dissatisfied with the ADA Coordinator’s written decision — or chooses to end the interactive process early — an appeal may be submitted within 15 business days of receiving the decision (or of ending the interactive process).
The appeal should include:
The complainant’s name, address, and contact information;
A copy of the original complaint and the ADA Coordinator’s decision (if applicable);
A statement explaining why the complainant disagrees with the decision or wishes to appeal; and
Any additional information or documentation relevant to the appeal.
The appeal should be addressed to the Village Administrator, Steve Kreklow at skreklow@germantownwi.gov or 262-250-4775 who will review all materials and may request additional information or a meeting.
Your Appeal may need to be presented to the legal councel and / or Village Board for consideration or approval. If that happens, you will be notified within 30 business days after receiving the appeal of the date this item will be added to the Village Board Agenda or if additional time is needed for Village's consulation with legal councel.
Within 7 days after the Village Board Meeting, the Village Administrator will issue a final written decision.
All written complaints and responses will be retained by the Village of Germantown for at least three years.
Upon request, the Village will provide reasonable accommodations and communication assistance so individuals with disabilities can fully engage in Village programs and services. Possible supports may include:
Sign language or oral interpreters
Large-print, Braille, or audio documents
Captioning or transcription
Accessible electronic formats
Assistive listening devices
We encourage requests as early as possible, ideally 72 hours in advance, so we can best support your needs.
The Village will make reasonable adjustments to procedures, practices, or policies when needed to ensure equal access, unless doing so would significantly alter operations or create undue hardship.
The Village strives to maintain a website that is usable and accessible for all individuals. Our goal is to align with recognized accessibility standards such as WCAG 2.1 Level AA.
While we continuously work to enhance accessibility, some older or third-party materials may not yet be fully optimized. If you encounter an accessibility barrier, we will provide the requested information in an accessible format as soon as possible.
